BARCELONA - THE LEGAL ARM OF CATALAN NOBILITY: GREAT TREATISE ON THE MILITARY ESTATE, 1684 Important legal-political treatise on Catalan nobility and the privileges of the so-called braç militar, one of the three estates of the Cortes of the Principality. Antonio de Vilaplana collects constitutions, decisions of the Sacred Royal Senate of Catalonia, responses by jurists, and historical precedents relating to immunity, prerogatives, and noble status. The work constitutes a foremost source for the study of Catalan public law in the second half of the seventeenth century. This Barcellonese edition of 1684, indicated by Palau as the second impression, presents the text in two columns with ample apparatus of legal citations. A modern parchment-binding exemplar, partially washed, overall fresh and legible, of a work today rather uncommon on the antique market. WHY TO BUY CATALAN PUBLIC LAW – Primary source for the institutional history of sixteenth-century Catalonia, with particular attention to the privileges and prerogatives of the nobility. SECOND IMPRESSION – The 1684 edition catalogued by Palau 365773 as a second impression, today not common on the market. AUTHORITATIVE JURIST – Vilaplana was a professor of civil law in Lleida, judge, veguer and batlle of Barcelona: the work thus springs from the direct experience of a protagonist of Catalan legal life. RICH LEGAL DOCUMENTATION – The treatise uses decisions of the Sacred Senate of Catalonia, jurist opinions, historical sources, municipal laws and privileges, offering a broad synthesis of the Catalan noble doctrine of the seventeenth century. MARKET VALUE For this exemplar, considering its rarity, apparent completeness and good internal condition, but also the modern binding and partial washing, a reasonable market range can be indicated at about €650–950. PHYSICAL DESCRIPTION AND CONDITION Recent full parchment binding, with title handwritten in Gothic style on the back: “Tractatus de Brachio Militari.” Parchment ties present on the boards. Latin text laid out predominantly in two columns, with dense marginal notes and numerous references to legal sources, constitutions, Catalan jurisprudence and earlier authors. Frontispiece within a typographic border, with a large central woodcut mark. Headpieces, friezes and tailpieces woodcut, some of considerable size, including the large floral vase visible at the end. Exemplar partially washed. Some small physiological foxing and light traces of time. Frontispiece with some ancient handwritten annotations partially attenuated by the washing. BRIEF BIOGRAPHY OF THE AUTHOR Antonio de Vilaplana was a seventeenth-century Catalan jurist, originating from the Lleida and Barcelona milieu. He was a professor of civil law at the University of Lleida, a judge of appeals, veguer and batlle of Barcelona. Catalan legal historiography also remembers him as an author of works on public law and feudal commentary. In 1670 he obtained knighthood and in 1694 nobility. He held positions in the Diputació and in the Catalan administration, up to involvement with the Real Audiencia. In 1679 he had also published Proposiciones cristianas y políticas. He was also a commentator on Peguera’s work on feudal rights and an annotator of Acaci de Ripoll’s Ordo judiciarius. PRINTING HISTORY AND CIRCULATION The Tractatus de brachio militari was printed in Barcelona in 1684 at the expense of the bookseller Josep Moya. The Biblioteca ABEV records the work as a Latin monograph published “Barcinonae: sumptibus Iosephi Moya, 1684.” Palau’s Bibliografía general española e hispano-americana lists this impression at number 365773; Soler y Llach explicitly defines it as the “second impression.” Modern studies on the history of Catalan law still cite the 1684 edition as a source for reconstructing the constitutions and noble prerogatives of the Principality. The work did not have the vast diffusion of the great Castilian or Roman legal treatises, remaining closely tied to Catalan institutional culture.
